How do we use your information?

This policy sets out the information we collect about you, what we do with it and who we share it with. Torque Motor Finance Limited may use information about you as follows:

  1. To handle your enquiry and arrange finance for the vehicle you have chosen, including passing your application to our principal firm and to lenders, and helping you complete the documents needed for your finance agreement.

We will contact you before this happens giving you all options and allowing you to opt out of this process if you wish. This third party may carry out additional credit reference searches against you.
  5. To help us develop and improve our services to you and other customers and protect our interests.
  6. We may offer additional products including warranty. If you choose to take one, your personal data and information will be passed to our warranty partner and payment provider for the purposes of providing you with this product. This third party may carry out additional credit reference searches against you.
  7. To prevent fraud, financial crime and misuse of our products and services.

Who we share your information with

We only share your information where we need to, and with organisations that help us arrange your finance or run our business:

  • Presto Finance Ltd, our principal firm, which is responsible for our regulated activities.
  • Lenders on our panel, so they can consider your application.
  • Credit reference agencies (Equifax, Experian and TransUnion) and fraud prevention agencies.
  • AutoConvert, the system we use to receive and manage finance applications.
  • Our warranty partner and payment provider, only if you choose to take a warranty.
  • Our technology and service providers, such as our email, document and website hosting providers, who process data on our behalf.
  • Regulators and dispute bodies, such as the Financial Conduct Authority and the Financial Ombudsman Service, where we are required to.

We do not sell your personal information.

Credit searches

When you submit an application through our website, a soft search may be carried out with a credit reference agency. A soft search lets us and our lenders understand your options. It is visible only to you and does not affect your credit score.

If you decide to go ahead with a finance application, the lender will usually carry out a full (hard) credit search. This will be recorded on your credit file and may be seen by other lenders.

The credit reference agencies explain how they use and share personal information in the Credit Reference Agency Information Notice (CRAIN), which you can read at experian.co.uk/crain.

Sharing information for finance applications

Where you apply for finance, we may share your personal information with lenders, finance brokers, credit reference agencies and other organisations involved in the assessment and administration of your finance application. These organisations may use your information to:

  • Assess your eligibility for finance
  • Verify your identity
  • Prevent fraud and financial crime
  • Meet legal and regulatory requirements
  • Manage any credit agreement entered

Further information regarding how these organisations use your information can be found within their own privacy notices.

Some lenders and credit providers may use automated decision-making processes when assessing finance applications. Where this occurs, the lender or finance provider will be responsible for informing you about their decision-making processes and your rights.

How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  1. Where we need to perform the contract or take steps in order to perform the contract we are arranging for you with a third-party lender to enter into.
  2. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  3. Where we need to comply with a legal or regulatory obligation.
  4. Where we have your consent to process your data.

We rely on your consent to send you marketing by email, text message or phone. You have the right to withdraw consent at any time by contacting us using the details below.

Retention of personal information

We will only retain personal information for as long as necessary to fulfil the purposes for which it was collected, including satisfying any legal, regulatory, accounting or reporting requirements.

We normally keep customer records for six years after our dealings with you end, in line with our regulatory obligations. Retention periods may vary depending upon the type of information held and the purpose for which it was obtained. Further details are available on request.

Marketing

We will only send you marketing by email, text message or phone if you have told us you are happy to receive it. You can choose this when you apply, and you can change your mind at any time.

We will not share your details with other companies for their own marketing.

To stop receiving marketing from us, reply STOP to any text message, use the unsubscribe link in any email, or contact us using the details below.
